The Federal Energy Regulatory Commission (FERC) published two proposed rulemakings yesterday. The first seeks supplemental comments regarding possible revisions to the posting requirements adopted in FERC Order 720 for major non-interstate pipelines (Docket No. RM08-2-000). Specifically, the Commission is looking for comments regarding various proposals to post information for virtual or pooling receipt and delivery points; the use of design capacity to determine whether a receipt or delivery point should be posted; and the use of an exemption for receipt points with de minimis gas flows even if the design capacity meets the posting threshold. Comments are due 30 days from publication in the Federal Register (which hasn't happened yet).
The second proposes to revise the FERC's contract reporting requirements for natural gas intrastate pipelines providing interstate service under Section 311 of the Natural Gas Policy Act and Hinshaw pipelines providing interstate service subject to the Commission's jurisdiction under a blanket certificate issued under s. 284.224 of the Commission's regulations (Docket No. RM 09-2-001). Among other things, the Commission proposes to require these entities to file quarterly reports of transportation and storage transactions; require that these reports include certain additional information (such as the rate charged under each contract, and its primary receipt and delivery points); and require that the reports be public information without redaction.
Comments are due 90 days after publication in the Federal Register.
