FERC: Regulation of NGL Pipelines

The Federal Energy Regulatory Commission (FERC) recently issued an order we thought you might find of interest.  In Williams Olefins Feedstock Pipelines, L.L.C., the FERC found that it had jurisdiction under the Interstate Commerce Act (ICA) over the interstate pipeline transportation of purity ethane, and refused to disclaim such jurisdiction under the circumstances raised in the petition filed by Williams.  See 145 FERC ΒΆ 61,303 (Dec. 31, 2013).  The test for disclaiming jurisdiction employed by the Commission:  "[W]hether the product being transported is a naturally-occurring hydrocarbon that is used or can be used for energy-related purposes, as opposed to having only a non-fuel, feedstock function."
