U.S. Supreme Court Rules Gas Price-Fixing Claims Not Preempted By NGA

The U.S. Supreme Court on Tuesday upheld a Ninth Circuit ruling that had revived state-law claims in multidistrict litigation against natural gas companies over price-fixing in the 2000s, rejecting arguments that the claims are preempted by the Natural Gas Act.

By a 7-2 vote, the high court affirmed the ruling, which held that Congress did not give the Federal Regulatory Energy Commission the right to oversee first sales or retail sales of natural gas and said the NGA provided "a regulatory role for the states" in the production of natural gas.
