A community activist group that opposes oil and gas wells in residential neighborhoods has lost another fight against Ohio and Gov. John Kasich.
Mothers Against Drilling in Our Neighborhood, based in Broadview Heights, claimed in the lawsuit that the city's Community Bill of Rights – which voters approved in 2012 and which bans future wells – supersedes a state law that allows drilling.
But Cuyahoga County Common Pleas Judge Timothy McCormick shot down that argument, citing the February Ohio Supreme Court decision in the case of Munroe Falls, which ruled that municipalities' home rule does not usurp state law regulating oil and gas drilling. The Supreme Court gave the Ohio Department of Natural Resources sole and exclusive authority to permit, locate, space and regulate oil and gas wells.
